Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Drumini website, applications, and related services (the "Services") operated by Drumini ("we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Description of the Services

Drumini provides an online platform that helps users discover verified non-governmental organisations (NGOs) in India and make donations in a structured, transparent manner. Features may include NGO profiles, categories, search, account management, and payment facilitation through third-party providers. We may modify or discontinue features with reasonable notice where practicable.

2. Eligibility and accounts

You must be legally able to enter a binding contract in your jurisdiction to use the Services in a capacity that requires registration. You agree to provide accurate, current information and to keep your credentials confidential. You are responsible for activity under your account except where caused by our gross negligence or wilful misconduct.

3. NGOs, verification, and listings

NGO profiles and "verified" or similar labels reflect our processes at a point in time. Verification does not constitute legal, financial, or charitable advice, and does not guarantee future conduct, regulatory status, or outcomes of funded programmes. NGOs are responsible for the accuracy of their submissions; we may remove or suspend listings that violate these Terms or applicable law.

4. Donations and payments

Donations made through the Services are voluntary. Payments may be processed by independent payment partners under their terms and applicable rules. You authorise us and our partners to charge or debit the payment method you provide for confirmed transactions. Receipts and tax treatment depend on the recipient NGO and applicable law; Drumini does not provide tax advice.

5. Refunds

Our approach to refunds is set out in the Refund Policy. In particular, once a donation has successfully completed, we do not offer refunds except as stated in that policy or where required by applicable law.

6. Acceptable use

You agree not to misuse the Services, including by attempting unauthorised access, interfering with security or performance, scraping in violation of our rules, uploading malware, harassing others, impersonating persons or entities, or using the Services for unlawful, fraudulent, or deceptive purposes. We may investigate and suspend or terminate access for breaches.

7. Intellectual property

The Services, including branding, layout, and software, are owned by Drumini or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Services for personal or internal business purposes related to permitted use of the platform.

8. Third-party content and links

The Services may contain links or integrations with third-party sites or services. We are not responsible for third-party content, policies, or practices. Your dealings with third parties are solely between you and them.

9. Disclaimers

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

To the fullest extent permitted by law, Drumini and its affiliates, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our aggregate liability for claims arising out of or relating to the Services shall not exceed the greater of (a) the amounts you paid to us in platform fees specifically for the Services in the three months preceding the claim, if any, or (b) a nominal amount where no such fees apply, except where liability cannot be limited under applicable law.

11. Indemnity

You agree to defend and indemnify Drumini against claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your violation of these Terms or law, except to the extent caused by our breach of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Courts in India shall have exclusive jurisdiction, subject to any non-waivable rights you may have under consumer protection or other mandatory local law.

13. General

If any provision is held invalid, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. These Terms together with our Privacy Policy and Refund Policy constitute the entire agreement regarding the subject matter here.
